Terms & Conditions of Sale

General

To place an order, browse the website and add any items that you wish to buy into your shopping cart. When you have finished your selection, go to ‘view basket’ and ‘checkout’ and you will be asked to provide the details required to enable us to complete the order.

Your order will be confirmed by e-mail. This will provide you with an order and Invoice number, and will confirm that payment has been received.

Certain goods may not be immediately available, and in this case you will be contacted by phone and/or e-mail to discuss how you wish to proceed. You will have the option to wait until the goods are available, or to cancel your order in part or in its entirety.

All orders made by you through blakley.co.uk are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances.

Specification

Blakley Electrics Ltd reserve the right to change the specification of its goods without notification and to substitute components of equivalent standard for those specified. All descriptions, illustrations, drawings, specifications, dimensions, standards or performance and other details given in quotations, literature or on blakley.co.uk are typical and non binding.

Pricing

The total cost of your order is the price of goods, Mainland UK delivery charges and VAT at the prevailing rate as defined during checkout.

Blakley Electrics Ltd operates a minimum order value of £50.00. Mainland UK carriage is £15.00 for all orders under £275, and free thereafter. Carriage is not charged if goods are to be collected from Blakley premises.

Although we endeavour to ensure that all pricing information on blakley.co.uk is accurate, occasionally an error may occur and goods or carriage may be mispriced. If we discover a pricing error, we will, at our discretion, either contact you and ask if you wish to continue the order at the correct price or notify you that we have cancelled the order. We will not be obliged to supply goods or carriage at the incorrect price.

Payment

Payment can be made using most major Debit or Credit Cards. We are not responsible for any charges from your card issuer or bank that may result from the processing of the payment in accordance with your order.

Payment must be made in full, including any carriage and VAT, before we can accept any order.

Delivery

Blakley Electrics Ltd will endeavour to deliver your goods as soon as possible. Orders are normally despatched the same day if received before 3pm. Delivery dates quoted are indicative only; Blakley Electrics will not accept any liability for any costs, loss or damage caused by delayed delivery.

In exceptional circumstances Blakley Electrics Ltd may be unable to honour the website generated Mainland UK delivery costs. Should this be the case you will be contacted by a Customer Services advisor and offered alternatives, which will include order cancellation.

Title

Legal title for goods ordered and paid for via blakley.co.uk passes at the point of despatch of goods.

Damage/Loss in Transit

Please note that it is your responsibility to check and sign for goods upon delivery. We are unable to process any claim for missing goods unless this is noted on the delivery note. Any items that appears damaged must not be accepted from the delivery driver.

Cancellation/Returns

Phone 0333 188 0284 (Mon-Fri 08.00 – 17.00) if you wish to cancel an order or return goods, and full instructions, along and with a returns note number if applicable, will be provided. Returned goods will not be accepted without the prior agreement of Blakley Electrics Ltd. You may cancel your order for any reason at any time before despatch of goods, or within 7 days from receipt. Returned goods must be unopened and unused unless faulty. The cost of return postage and risk in transit are your responsibility, and we recommend that goods are returned in a manner requiring signature upon receipt. Any goods returned unopened, unused and undamaged will be refunded less a 10% handling charge. Goods that are returned as faulty and under warranty will be thoroughly inspected and you will be notified of our findings. Returns warranting credit will be processed within 30 days from receipt.

Warranties and Limitation of Liability

Blakley Electrics Ltd will replace or repair goods which fail within one year of purchase either from faulty materials or workmanship, provided there is no evidence of misuse or alteration. Goods reported by the buyer as faulty during this period must be returned to the Blakley Electrics premises at the cost and risk of the buyer, where they will be inspected, and if appropriate repaired or replaced.

Blakley Electric’s goods are supplied without any warranty, condition or guarantee express or implied that they are suitable for use under any special conditions or for any particular purpose or to their quality or suitability for any particular purpose even though that purpose may be have been known to them. Under no circumstances shall Blakley Electric’s liability for direct loss or damage other than death or personal injury resulting to the buyer from any defect in the goods exceed the purchase price of the goods in respect of which such loss is claimed. Blakley Electrics shall, under no circumstances, be responsible for any consequential loss or damage arising in connection with any goods supplied.

Health and Safety at Work Act

Your attention is drawn to the provisions of section 6 of the Health & Safety at Work Act 1974. It is important that electrical goods are installed, commissioned and maintained by or under the supervision of competent persons in accordance with good engineering practice and current IEE regulations, BSI codes of practice, Statutory requirements and any instruction specifically advised by Blakley Electrics Ltd and where appropriate with specific reference to information marked on the goods or supplied with them. The responsibility for safe use and installation rests with you, and where appropriate you must make sure that any relevant information is made available to anyone concerned. The goods supplied by Blakley Electrics when used in normal or prescribed applications within the specifications for mechanical and electrical performance provided for the product will not cause any danger or hazard to health and safety if normal engineering practices are observed and they are handled and used by skilled and trained persons in accordance with the relevant regulations (including I.E.E wiring regulations) and the accepted rules and practices for the industry concerned. Unless specifically stated otherwise electrical products should not be handled while power is connected.

Waste Electrical and Electronic Equipment (“WEEE”)

The buyer shall be responsible for financing the collection treatment recovery and environmentally sound disposal of all WEEE arising or deriving from the goods and all WEEE arising or deriving from goods placed on the market prior to 13 August 2005 where such goods are to be replaced by the goods and the goods are of an equivalent type or are fulfilling the same function as that of such goods and to comply with all additional obligations placed upon the buyer by the WEEE Regulations by virtue of the buyer accepting the responsibility herein and to provide the Company’s WEEE compliance scheme operator with such data, documents, information and other assistance as such scheme operator may from time to time reasonably require to enable such operator to satisfy the obligations assumed by it as a result of the Company’s membership of the operator’s compliance scheme. The buyer shall be responsible for all costs and expenses arising from and relating to its obligations above.
